1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of Melda, including our website at melda.co, Chrome browser extension, and related services (the "Service").

By creating an account or using Melda, you agree to these Terms. If you don't agree, please don't use the Service.

2. What Melda Does

Melda is an AI-powered content capture and script generation system for creators. The Service allows you to:

  • Capture inspiration and your own content from web, extension, and mobile inputs
  • Extract reusable nuggets, hook templates, and vibes with AI
  • Combine selected components in the Meld flow
  • Generate and refine scripts in your authentic voice

We strive to keep Melda available, but can't guarantee uninterrupted access. The Service may occasionally be unavailable for maintenance or updates.

3. Eligibility

You must be at least 16 years old to use Melda.

4. Your Account

When you create an account:

  • Provide accurate information
  • Keep your password secure
  • You're responsible for all activity under your account

Notify us immediately at info@melda.co if you believe your account has been compromised.

5. Connected Social Media Accounts

When you connect YouTube, TikTok, or Instagram to Melda:

  • You authorize us to access your account data as described in our Privacy Policy
  • You're responsible for complying with each platform's terms of service
  • You can disconnect any account anytime through your Melda settings
  • We'll delete data from disconnected accounts within 30 days

We're not responsible for changes third-party platforms make that affect Melda's functionality.

6. Acceptable Use

You may:

  • Organize and manage your own content
  • Save publicly available content for personal inspiration
  • Analyze your content performance
  • Generate content ideas for your own use

You may NOT:

  • Use Melda for anything illegal
  • Upload content that infringes others' rights
  • Use automated means to bulk-scrape data beyond normal functionality
  • Attempt to reverse engineer, interfere with, or compromise the Service
  • Resell or redistribute access without our written consent
  • Republish or claim ownership of other creators' content you save

7. Your Content

You own your content. When you upload or create content through Melda, you retain full ownership.

You grant us a limited license to store and process your content solely to provide the Service (transcription, template extraction, AI generation). This license ends when you delete your content or account.

You're responsible for ensuring you have rights to any content you upload.

8. AI Processing

Melda uses third-party AI services (including OpenAI, Google, Anthropic, and compatible hosted providers) to power transcription, extraction, and content generation features.

When you use these features:

  • Your content is processed by these AI providers
  • We select providers with appropriate data protections
  • We do not use your content to train AI models

AI-generated content is provided as assistance only. You're responsible for reviewing and editing any AI-generated content before use.

9. Intellectual Property

Melda's design, features, and functionality (excluding your content) are our property and protected by intellectual property laws. Don't copy, modify, or create derivative works without our consent.

If you provide feedback about the Service, you grant us permission to use it freely.

10. Payment and Billing

Subscriptions: Billed in advance on a monthly or annual basis. You authorize us to charge your payment method for applicable fees.

Free Trials: If offered, you'll be charged at the end unless you cancel beforehand.

Cancellation: Cancel anytime through your account settings. You'll retain access until the end of your current billing period.

Refunds: We offer refunds on a case-by-case basis. If you believe you're entitled to a refund, contact us at info@melda.co within 7 days of your charge.

11. Account Termination

You can delete your account anytime by contacting info@melda.co or through your account settings. We'll delete your data within 30 days.

We may suspend or terminate your account if you violate these Terms, engage in harmful conduct, or if required by law.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We don't guarantee that:

  • The Service will be uninterrupted or error-free
  • Results will be accurate or reliable
  • The Service will meet your specific needs

We're not responsible for:

  • Changes to third-party platform APIs
  • Actions taken by third-party platforms regarding your accounts
  • Any loss of access to connected accounts

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED:

  • The amount you paid us in the 12 months before the claim, OR
  • One hundred US dollars ($100)

We're not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data.

14. Indemnification

You agree to indemnify and hold us harmless from claims arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Dispute Resolution

Let's try to work it out first. Before filing any legal claim, contact us at info@melda.co. We'll try to resolve disputes informally within 60 days.

Governing Law: These Terms are governed by the laws of the State of Wyoming, USA.

Individual Claims Only: Any dispute resolution will be conducted on an individual basis, not as a class action.

16. General

  • Entire Agreement: These Terms and our Privacy Policy are the complete agreement between us
  • Severability: If any part is unenforceable, the rest remains in effect
  • Assignment: You can't transfer your rights; we can transfer ours
  • Force Majeure: We're not liable for delays due to circumstances beyond our control

17. Changes to Terms

We may update these Terms. We'll notify you of material changes by posting them with a new date and emailing you when significant.

Continued use after changes means you accept the new Terms.
